Accountability is a core behavior of FPG Mercantile Insurance Co., (herein referred to as “FPG Mercantile”, “we”, “the Company” and “us”). In line with this, we dedicate and commit to protect and respect your privacy rights when you interact or establish business relationship with us.

This Privacy Notice sets out the extent of the Company’s processing of your personal information, sensitive personal information and privileged information (collectively, “Personal Data”), including the Company’s data processing practices.

FPG Mercantile’s processing of personal data is aligned with the Data Privacy Act of 2012, its Implementing Rules and Regulations (“IRR”), and the issuances of the National Privacy Commission (“NPC”), (collectively, “Data Privacy Laws”), and consistent with the privacy principles of transparency, legitimacy, and proportionality.

How we collect your Personal Data

We collect your Personal Data directly from you manually (as when you accomplish forms or when you make correspondences with us) or digitally (as when you browse and navigate our website, or when you use our online platforms), or through our intermediaries and partners (like our insurance agents and your insurance brokers).

For our website and online platforms, please note that we may collect aggregated data such as site-visit statistics like your IP address, domain names, access times and referring website addresses.

In any case, the aggregated data we collect will not include personally identifiable information.

Why we Collect and Process Your Personal Data

We collect and process your Personal Data mainly to carry out our legitimate business and commercial operations, and always in accordance with the contractual requirements and legal mandates under the Amended Insurance Code of the Philippines, the Anti-Money Laundering Act of 2001, Terrorism Financing Prevention and Suppression Act, and such other laws consistent with the Data Privacy Laws.

How we Use and Process your Personal Data

In pursuit of our business, we use and process your Personal Data to:

• prepare insurance quotations and proposals that are consistent with your insurance needs;
• issue insurance policies, including insurance policy renewals;
• collect premium payments on the insurance contracts;
• provide you support you request relative to your insurance policy;
• address your inquiries relating to our business;
• allow us to understand and assess your insurance needs, to provide you with our services and commitments under your insurance policy; and
• comply with our due diligence, reporting and retention obligations under applicable laws, and other legal orders and processes.

How we store and transmit your Personal Data

In ordinary course of business, we retain your Personal Data for as long as necessary to the fulfillment of the purposes for which the data was collected or for the establishment or defense of legal claims, or for legitimate business purposes, or as provided by law.

To the extent that is necessary and reasonable for us to conduct our business, and to comply with laws and regulations, we may share your Personal Data to:

• our subsidiaries and affiliates for business development, marketing services, accounting services, underwriting and risk management services, and claims services;
• the Insurance Commission, courts of law, and other competent authorities;
• our vendors supplying us goods and services necessary for the conduct of our legitimate business;
• our intermediaries such as our agents and your insurance brokers;
• our reinsurers, brokers, claims investigators, loss adjusters, third-party administrators and other business partners; and
• authorized third parties providing ancillary services supporting us in our use of machine learning technologies.

Exercise of Your Privacy Rights

In cases where you consider that the processing of your personal information is in violation of applicable privacy laws, you have the right to file a formal complaint to the National Privacy Commission. To file a complaint, the data subject may opt to personally go to the NPC Office or electronically send it via [email protected] .

We also recognize your rights as data subject under the Data Privacy Act of 2012, which includes the following:

1. right to be informed that your personal information will be collected and processed;
2. right to be furnished information in relation to the processing of your personal information;
3. right of reasonable access to your personal information;
4. right to dispute any error in your personal information and have it corrected;
5. right to erasure or blocking of your personal information if said information is incomplete, outdated, false, unlawfully obtained, used for unauthorized purposes or no longer necessary for the purposes for which;
6. right to object to the processing of your personal information;
7. right to lodge a complaint before the National Privacy Commission, and
8. right to damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your personal information.

How we dispose of your Personal Data

We follow safe destruction and disposal of personal data. Disposal of electronic data is subject to secure electronic deletion or anonymization. While physical files are being disposed through shredding machines.
